These Terms of Use constitute a legally binding agreement between you and Stratum Health Coaching, operated by J. Mace Hamblin, DHSc, MPA, NBC-HWC, PN1 (“Stratum,” “we,” “us,” or “our”). These terms govern your access to and use of the Stratum Health Coaching website and the information, content, and services available through it.

Health and wellness coaching is a structured behavioral support service that operates within the defined scope of practice of a National Board-Certified Health & Wellness Coach (NBC-HWC) as established by the National Board for Health and Wellness Coaching (NBHWC). Coaching is designed to complement — not replace — clinical medical care.
You are solely responsible for all decisions you make regarding your health, including decisions about diet, physical activity, medications, and medical treatment. Original coaching materials
All coaching frameworks, program structures, intake tools, worksheets, and written materials created by Mace Hamblin and used in the delivery of Stratum Health Coaching services are original works and proprietary to Stratum Health Coaching. Clients may use materials provided to them for personal use only. Redistribution, reproduction, or commercial use of any coaching materials is strictly prohibited without written consent.
Third-party content
Where coaching services reference or utilize third-party assessments or tools, those materials remain the intellectual property of their respective owners and are subject to those owners’ terms of use. Stratum Health Coaching does not claim ownership over any licensed third-party tools. Specifically, the EQ-i 2.0® is a registered trademark of Multi-Health Systems Inc. (MHS), and the EQ-i 2.0 assessment instrument, scoring platform, and related reports are the exclusive intellectual property of MHS. Stratum Health Coaching administers the EQ-i 2.0 under a valid practitioner license issued by MHS and does not own, reproduce, or sublicense the instrument or its content. All EQ-i 2.0 materials are used strictly in accordance with MHS licensing terms and the ethical guidelines of the assessment profession.

Submission of information through our website contact form does not create a coach-client relationship. A coach-client relationship is established only upon execution of a signed Client Agreement and Informed Consent. Prior to that execution, any information you submit through our website or share in a preliminary consultation is treated with discretion but does not carry the full confidentiality protections of the coach-client relationship.
We will make reasonable efforts to respond to inquiries submitted through our contact form within 2 business days. Response times are not guaranteed and do not constitute a commitment to provide services.
7. HSA/FSA Eligibility — Disclaimer
Stratum Health Coaching provides coaching services that may qualify for reimbursement through Health Savings Accounts (HSA) or Flexible Spending Accounts (FSA) when accompanied by a Letter of Medical Necessity from a licensed healthcare provider. However, HSA and FSA eligibility determinations are made by individual plan administrators and the IRS, not by Stratum Health Coaching.
Stratum Health Coaching makes no guarantee that coaching fees will be approved for reimbursement by your HSA or FSA plan administrator. You are solely responsible for verifying eligibility with your plan administrator before relying on HSA or FSA funds to pay for coaching services. Stratum Health Coaching will provide itemized receipts to support reimbursement requests but accepts no liability for reimbursement denials.

This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Stratum Health Coaching disclaims all warranties, including but not limited to:
Health and wellness outcomes depend on many factors beyond the scope of coaching, including individual effort, consistency, adherence to medical care, and variables outside the coach’s control. Stratum Health Coaching does not guarantee any specific health result from participation in coaching services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Stratum Health Coaching, its owner, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to damages for personal injury, loss of health, lost profits, lost data, or business interruption — arising out of or related to your use of this website or coaching services, even if Stratum Health Coaching has been advised of the possibility of such damages.
In no event shall Stratum Health Coaching’s total liability to you for all claims arising out of or related to the use of this website or coaching services exceed the total amount paid by you to Stratum Health Coaching in the six months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms of Use or your use of this website or coaching services shall be subject to the exclusive jurisdiction of the state and federal courts located in Utah County, Utah.
Before initiating any legal proceeding, the parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation is unsuccessful, the parties agree to submit the dispute to non-binding mediation before pursuing litigation.
12. Severability
If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms of Use. The remaining provisions shall continue in full force and effect.

These Terms of Use, together with our Privacy Policy and — for coaching clients — the executed Informed Consent and Client Agreement, constitute the entire agreement between you and Stratum Health Coaching regarding your use of this website and coaching services.
